Statutory timelines have been extended, including time to exercise your options on the Offence Notice (ticket). Please refer to the Ontario Court of Justice Order November 25, 2020 for further details.
If you received an Offence Notice (ticket) after March 1, 2020, you have until February 26, 2021, to exercise one of the options set out on the back of the ticket. If you do not respond by February 26, 2021, you may be deemed not to dispute the charge and a Justice of the Peace may enter a conviction for the offence.
Ticket options
If you are issued a Provincial Offence ticket, you should carefully read payment and trial options on the back of the ticket. Within 15 days of receipt of your offence/ticket – you must select one of the 3 options shown on your offence notice. If you do not exercise one of these 3 options – you will be deemed not to dispute the charge and a Justice of the Peace may enter a conviction against you in your absence. Upon conviction, additional costs will be added to the total payable.
Option 1 - payment
By choosing this option you are stating that you do not dispute the charge and you must pay the total payable on the offence/ticket.
Option 2 - plea of guilty with submissions as to penalty
By choosing this option knows as a “walk-in-guilty” you are stating that you are guilty but wish to provide more information about your ability to pay the fine or that you need more time to pay.
At this time a virtual appointment must be scheduled in advance with a Justice of the Peace.
Please call the Provincial Offences Office at 807-467-2984 to schedule an appointment.
Option 3 - trial request
If you wish to plead not guilty, you must sign Option 3 on the back of the ticket. You can mail it or drop it off at the POA office at 1 Main Street South, Kenora. You will receive a Notice of Trial by mail; please make sure your mailing address is correct on the ticket. If you do not receive a Notice of Trial in 3-4 weeks, contact the Provincial Offences Court office to confirm the status.
You must choose one of the three options within 15 days from the date you received the offence notice. If you fail to respond, the notice will be processed as undisputed.
